Article 1 : General Terms1. The underlying general conditions of sale regulate the rights and obligations of the buyer (you) and the vendor (us or Lella L), related to the products sold on our website in the frame of a mail-order business. They also define the navigation conditions on the website.
2. Before proceeding with any order, we recommend that our customers connected to our website, carefully read the underlying general conditions of sale.
3. Order taking for products presented in the electronic catalogue of our website is subordinated by the buyer’s acceptance of the general conditions of sales. It is equivalent without any reserve by the buyer to the full acceptance of the general conditions of sale detailed below. The buyer’s acceptance is materialized by his/her electronic signature when he/she will double click to confirm his/her acceptance at the end of the ordering process. Such electronic signature is equivalent to a handwritten signature between parties.
4. “Lella L” reserves for itself the right to adapt or modify at any time the present conditions, partially or totally. It is however clear that the general condition of sale valid for a given order are the ones applicable on the website the date your order is processed and registered.
5. The opportunity to buy on-line on our website is reserved to private individuals having reached the legal majority ages for personal utilisation without any link with a professional activity.
Article 2 : Orders
You have the possibility to order on our website.
1. “Lella L” will confirm receipt of your order only if the following elements of information have been transmitted to us :
a. Buyer’s Last and First name
b. Full address of the buyer
c. Full delivery address if it is different from the buyer’s address (postal mailboxes are not accepted)
d. Buyer’s home phone number and/or mobile phone number
e. Buyer’s email address
f. Reference number of the product ordered
g. The desired quantity for each article ordered
h. The unit price for each product ordered
i. The total price for each product ordered if the number of units ordered for a given product is more than one
j. The payment method
2. When confirming your order, you are accepting the entire general conditions of sales without discussion, the product description and the applied prices. When confirming your order, you are declaring and you are recognizing having a perfect understanding of the general conditions of sales and you are accepting them in totality without any reserves, renouncing to produce any contradictory document, among others your own general conditions of purchase. Your order confirmation and the entire set of data collected will constitute the proof for the transaction registered between the vendor and the buyer.
3. As soon as your order is registered, will we send you a receipt acknowledgement summarizing your full details, the product description, the quantity ordered, the price inclusive of taxes (VAT), costs for shipping and handling included, the payment and delivery details and the reminder about your right to revoke the purchase during a given period. Such email, confirms that your order has been accepted by “Lella L” and does not guarantee that the product is available.
4. “Lella L” has full rights to refuse, without any responsibility on our side, any order coming from a buyer, based on a justified reason, among others the fact that it may exist a doubt or litigation related to the payment of a previous order. Also, any order or delivery can be interrupted in case the payment processing is refused by the financial organizations managing and authorizing the payment to us.
Article 3 : Price1. The price of our products are indicated in EUROS, including 21% for VAT (value added tax), without handling and shipping charges which will be indicated during the purchase process and before final validation from you.
Shipping expenses invoiced by “Lella L” correspond to a fixed rate participation to actual shipping costs and will amount to :
5.5€ for an order delivered in Belgium
13.5€ for an order delivered in another member state of European Union
75€ for an order delivered in a country outside European Union
2. “Lella L” has full rights to modify the prices at any time and without notice in case of a price variation for the goods, but commits to apply the prices indicated during the registration process of your order, product the product is available at that date.
3. For any order going to a different country than Belgium, the buyer is considered as an importer for the products ordered. “Lella L”’s responsibility will not be engaged in any case, should you not respect the local importing legislation of the countries where our products will be delivered. The buyer should verify the importation regulation with the adequate local authorities where the product are delivered and make sure he/she will respect them under his/her sole responsibility.
4. For shipments outside of European Union, the price will be calculated without VAT on the invoice. Custom rights and other local taxes, import rights may be demanded and will be at the buyer’s charge and under his/her responsibility for everything related to administrative/customs declarations, payments to local authorities and tax administrations. We advise the buyer to check with his/her local authorities/custom administration first before ordering.

Article 5 : Product Availability1. Our product offer and the prices are valid as long as they are visible on the website, within the limit of available inventory.
2. Most of the products presented on the “Lella L” website are produced in very limited series, resulting to a limited number of pieces in stock. The product availability, per size is mentioned on the product pages
3. If the product is available, it will be sent to the delivery address communicated by the buyer within a maximum of 30 days as of the date of payment receipt. A delivery time estimation will be forwarded to you once we have received your registered order. Such estimation is provided as general information and is non-binding.
4. For the products “available when ordered” or “created tailor made” or in case of an unpredicted stock shortage, we will inform you about a possible delivery date extension. If this new delivery date should not satisfy you, you will have the possibility to cancel your order and obtain full reimbursement or order one or several other articles to replace the unavailable product. Without any answer from you within 7 days following our email detailing the delivery date extension, the order and the new delivery date will be considered as accepted.
5. “Lella L” cannot be held responsible for non respect of the delivery date if it is the result of a beyond control situation such as strikes, postal services complications, transportation and communication issues, fire, floods, theft or any other similar circumstances resulting into the delivery date delay or the impossibility for “Lella L” to deliver. We will not need to establish the unpredictable or irresistible character of such circumstance, nor the impossibility to execute the contract. If the circumstances would compromise the order execution respecting the standard terms agreed , we reserve the right , after informing you to cancel all or part of the order which could not be delivered. In that case, we will reimburse you for the amounts that you may already have paid for the part of the order cancelled.
Article 6 : Shipping
1. The products are delivered by a parcel delivery company to the delivery address communicated to us during the ordering process.
2. The delivery takes place during office opening hours. Make sure that somebody will be present at the delivery address communicated to us.
3. The delivery will be considered as realized the date of the first product presentation to the delivery address. After that date, “Lella L” will not be responsible for the delivery of the ordered product or for any additional cost that the transporter may claim to organize subsequent visits. If you are absent when the product is presented to the delivery address, you have the responsibility to get in touch with the parcel delivery company to organize a second visit or obtain your product directly at the office or logistic base of the transporter, which will hold it for 15 days. After 15 days, the product will be sent back to us at our own expenses; all additional shipping expenses to send the product again will be at your charge.
4. “Lella L” cannot be held responsible in case of delayed delivery, whatever the reason could be.
5. You are advised not to sign a delivery receipt without having previously controlled the parcel and its content. In case of damages resulting from transport conditions and recognized upon delivery or in case of non conformity of the product delivered when compared with the indications mentioned on the purchase order, you will have to imperatively mention specific and accurate reserves on the receipt document. In order to be accepted, all claims should be forwarded to us within the 24 hours following the product reception, otherwise the delivery will be considered as accepted by the buyer. In all cases, our responsibility will be limited to plain an simple replacement of the damaged product, only if our responsibility can be proven.
6. In order to minimize the risks, the products ordered will always be delivered in an anonymous package, without any references to “Lella L”
Article 7 : Transfer of ownership - Transfer of risk
Transfer of ownership regarding the products ordered takes place once the full price for the product has been received, handling and shipping costs, VAT included, whatever the delivery date will be. Transfer of risk regarding the products ordered takes place the day of the first presentation of the product(s) by the parcel delivery company to the delivery address indicated.
Article 8 : Revocation rights
1. In line with the legal dispositions, the buyer has the right to notify the vendor that he/she does not want to buy the product, without any penalty and any motivations, within the 14 opening days as of the day following the delivery day (delivery day corresponds to the first time the product was presented to the delivery address)

3. Returns will not be considered for :
• Uncompleted articles, damaged, spoiled, showing signs that it has been used, without the original packaging or without the sealed linked sticker “Lella L”
• All earrings , for obvious health and hygienic reasons
• All products crafted and custom made for you, which necessitated a special order
4 Miscellaneous delivery and return costs always remain at the buyer’s charge. Returns take place at buyer’s risk. We advise you to select a secured mode of shipment.
5. Should you decide to revoke your order, the reimbursement (net of delivery and return expenses) will take place within a maximum of 30 days following revocation, under the reserve that the products are coming back in excellent condition as described under point 3 above. Reimbursements will be done using the most appropriate payment method for “Lella L” depending on each case.

Article 9 : Return for exchanges
1. You have the possibility to return the jewels which would not please you up to 14 days after the delivery day. You will be able to exchange the jewel or obtain a refund (after deduction of shipping costs)

4. Only one exchange per article will be allowed.
5. All jewels must be returned with a copy of the “Lella L” original invoice as well as a few words explaining the reason for the return with the return number previously communicated to you by “Lella L”. Moreover, you should indicate if you prefer to proceed with an exchange against another article from our on-line store or if you elect to obtain a reimbursement (after deduction of shipping costs).
6. Miscellaneous shipping and return costs are always at the customer’s charge. Returns take place under the customer’s responsibility. We advise you to chose a secured delivery mode.
7. The reimbursement or exchange will take place maximum 30 days after reception of the product by “Lella L”, depending on our inventory availability and only if the product that you have sent back to us is conform with the one originally sent to you, without damages, modifications or alteration as described above. In case of an exchange, if the exchange value of the chosen product is higher, you will be requested to pay the difference before we ship you the exchange. In case the exchange value of the chosen product is lower, we will credit you for the difference. In case of reimbursement, “Lella L” is entitled to choose the most adequate payment methodology. 8. Article 10 : Garantee for hidden defect and responsibility1. The proposed products are conform to the Belgian legislation applicable and we do our best to satisfy you in the context of our obligation to take the necessary steps to achieve efficiency.
2. “Lella L” will not be held responsible for any contractual default resulting from damages caused by the customer, accidental events or beyond control events such as, but without limitation, stock shortages, product unavailability, default or unsatisfactory service level from our suppliers, disruptions, partial or total strikes in postal services, transport and communication providers, natural catastrophes, fire, flood, thefts, Lella L equipment and software breakdowns, restrictions put on us by authorities.
3. The product choice and its purchase are your sole responsibility. Total or partial impossibility to use the products resulting from product incompatibility will not give right to any compensation, reimbursement or claim stating that Lella L is responsible, with the exception of hidden default, defectuous product or your right to revoke the purchase obligation as stated under article 8. In the last three cases, “Lella L” will be allowed to choose to eiter eliminate the hidden default, replace the defectuous product with another one or reimburse the buyer.
4. “Lella L” ‘s responsibility shall not be engaged no matter what, in case of non respect of the local legislation where the products are delivered. It will be the responsibility of the buyer to verify with the competent authorities of his/her country about the possibilities, conditions and obligations to import the products that the buyer considers ordering and to respect such rules under his/her sole responsibility.
5. The pictures, texts, illustrations presenting the products are indicative and are not part of the contractual frame. “Lella L” will not be responsible for any difference that could be found between the products presented on the website and the products delivered.
6. “Lella L” will not be responsible for the contents of any website referenced on www.lellal.com, as well as for the contents of the websites referencing “Lella L”
7. Any hypertext link sending the internet user back to the “Lella L” website, using techniques such as framing, deep-linking, in-linking or any other linking technique is strictly forbidden.
8. “Lella L” willnot be responsible for the consequences related to a malicious act from a third, which may result into a modification of our website contents. Article 11 : Private life1. Private and personal information forwarded to “Lella L” will be used for the good execution of the orders and for the personalization of any communication following the order. Your personal information will be treated confidentially. Unless you clearly express it and in particular situations clearly mentioned on the website, such data can be shared with a third party supplier for the direct and related needs related to the contract execution (shipping and delivery) concluded with you and only if there is a contractual relationship between “Lella L” and the third party supplier.

Article 13 : Applicable law and legislationThe general conditions of sales above are subject to Belgian law. In case of litigation, only Belgian courts will be deemed as competent to rule. French only will be the language in case of litigation.
